Terms of Service

1. Acceptance

By subscribing to or using the FamilyChart managed hosting service, you agree to be bound by these Terms of Service. If you do not agree, do not use the service.

These terms form a legally binding agreement between you and Benjamin Horder, trading as WheelieLabs (ABN 55 846 950 339).

2. Service description

FamilyChart is a family medication and health tracking application. The managed hosting service provides you with a private, hosted instance of FamilyChart at a subdomain we allocate to you, accessible over the internet.

During Early Release, managed instances are provisioned manually rather than automatically. After you subscribe, we will set up your instance and notify you by email once it is ready — typically within 1 business day.

The underlying software is open source and licensed under the GNU Affero General Public Licence v3.0 (AGPL-3.0). You may also self-host FamilyChart at no charge under those licence terms.

3. Eligibility

You must be at least 18 years old to subscribe. By subscribing, you represent that you meet this requirement. The service is intended for personal and family use within Australia, although subscribers outside Australia may use the service subject to accepting that Australian law governs these terms.

4. Subscription and billing

The managed hosting service is offered on a subscription basis. We are currently in Early Release: subscribers who sign up on or before 31 October 2026 pay A$9 per month (billed monthly in advance) or A$90 per year (billed annually in advance), locked in for the life of the subscription. After that date, new managed hosting subscriptions are priced at A$12 per month or A$120 per year. Payments are processed by Stripe. Your subscription renews automatically at the end of each billing period until cancelled.

You authorise us (via Stripe) to charge your nominated payment method on a recurring basis (monthly or annually, according to the billing interval you select). Prices are in Australian dollars. WheelieLabs is not currently registered for GST, so no GST is added to the prices shown — this may change if registration becomes required in future.

We reserve the right to change pricing with at least 30 days' notice by email.

5. Cancellation and refunds

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period — you retain access until then. We do not offer pro-rata refunds for the unused portion of a billing period.

Nothing in this clause limits any rights you may have under the Australian Consumer Law (see clause 10).

FamilyChart is a record-keeping tool, not a medical device or clinical service. Nothing in the application constitutes medical advice, diagnosis, or treatment. Always consult a registered healthcare professional before making decisions about medications or health care.

We are not responsible for any harm arising from reliance on information recorded in FamilyChart.

8. Intellectual property

The FamilyChart software is licensed under AGPL-3.0. The source code is available at github.com/WheelieLabs/familychart.

All data you enter into FamilyChart belongs to you. We claim no ownership over your personal or health data. You grant us a limited, non-exclusive licence to store and process your data solely for the purpose of providing the service.

9. Limitation of liability

To the extent permitted by law, our total liability to you for any claim arising from these terms or the service is limited to the amount you paid us in the 3 months preceding the event giving rise to the claim.

We are not liable for any indirect, consequential, or special loss or damage, including loss of data, even if we have been advised of the possibility of such loss.

10. Australian Consumer Law

Our services come with guarantees that cannot be excluded under the Australian Consumer Law (Schedule 2, Competition and Consumer Act 2010 (Cth)). Nothing in these terms excludes, restricts, or modifies any right or remedy you have under the Australian Consumer Law.

Where we are permitted to limit our liability for a failure to comply with a consumer guarantee, our liability is limited (at our option) to re-supplying the service or paying the cost of having the service re-supplied.

11. Service availability

We aim for high availability but do not guarantee uninterrupted service. We may take the service offline for maintenance, and we will endeavour to give advance notice where possible. We are not liable for losses caused by planned or unplanned downtime.

12. Termination

We may suspend or terminate your account if you materially breach these terms and fail to remedy the breach within 7 days of written notice. We may also terminate the service entirely with 30 days' notice to all subscribers, in which case we will provide a pro-rata refund of any prepaid fees.

13. Governing law

These terms are governed by the laws of South Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of South Australia.

14. Changes to these terms

We may update these Terms of Service. For material changes, we will provide at least 30 days' notice by email before the new terms take effect. Continued use of the service after that date constitutes acceptance of the updated terms.
